PLEASE READ THESE TERMS CAREFULLY. By accessing or using Questah, you agree to be bound by these Terms of Service. Questah is provided "AS IS" without warranties of any kind. As an early-stage startup, our service may contain bugs, experience downtime, or change without notice.

1. Acceptance of Terms

By accessing or using the Questah platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We reserve the right to modify these Terms at any time. Continued use after changes constitutes acceptance.

2. Description of Service

Questah is a staffing platform that connects agencies, businesses, and contractors. We provide tools for job posting, candidate management, timesheet tracking, invoicing, and payment processing. The Service is provided on an "as available" basis and may be modified, suspended, or discontinued at any time without notice.

3. Account Registration

To use the Service, you must:

  • Be at least 18 years old
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion without notice or liability.

4. User Responsibilities

You agree to:

  • Use the Service only for lawful purposes
  • Comply with all applicable laws and regulations
  • Not misrepresent your identity or qualifications
  • Not upload malicious code or interfere with the Service
  • Not attempt to gain unauthorized access to any systems

5. Payment Terms

Payment processing is handled through third-party providers (e.g., Stripe). By using our payment features, you agree to their terms of service. Questah is not responsible for payment processing errors, delays, or failures. All fees are non-refundable unless otherwise stated. We reserve the right to change pricing at any time.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by Questah and protected by copyright, trademark, and other laws. You retain ownership of content you submit but grant us a worldwide, royalty-free license to use, reproduce, modify, and display such content in connection with the Service.

7. Third-Party Services

The Service may contain links to or integrate with third-party services. We are not responsible for the content, privacy policies, or practices of third parties. Your use of third-party services is at your own risk and subject to their terms.

8. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • AVAILABILITY, ACCURACY, OR RELIABILITY
  • SECURITY OR ERROR-FREE OPERATION

QUESTAH IS AN EARLY-STAGE STARTUP. WE DO NOT GUARANTEE THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, SECURE, OR ERROR-FREE. USE AT YOUR OWN RISK.

9. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL QUESTAH, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
  • DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO YOUR DATA
  • DAMAGES RESULTING FROM SERVICE INTERRUPTION OR ERRORS
  • DAMAGES RESULTING FROM THIRD-PARTY CONDUCT OR CONTENT

OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR $100, WHICHEVER IS LESS.

10. Indemnification

You agree to indemnify, defend, and hold harmless Questah and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or violation of any rights of another party.

11. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service ceases immediately. We are not obligated to retain your data after termination and may delete it without notice.

12. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to participate in class actions. The arbitration shall take place in the jurisdiction where Questah is headquartered.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Questah regarding the Service.
